Indian Permanent Residency

Persons of Indian Origin (PIO Card)

The Indian immigration authorities have had "The Persons of Indian Origin scheme (PIO)" since 1999 and it is designed to allow people who have not been awarded the Indian citizenship or permanent residency but are still allowed to claim Indian parentage to settle in India. The PIO scheme applies to people who have Indian origin i.e. if they were born in India or if one of their parents or grandparents were born in India. A PIO visa is usually granted for 15 years and although it is not directly a grant for permanent residence, applicants can apply for a further extension to the visa after seven years of residing full time in India and in possession of a PIO card, then an applicant may apply to become an Indian citizen. PIO visas can be awarded via application to both the main applicant and their spouse which in return will permit their holders to travel in and out of India as often as they choose to, they can also study in India without the need for an Indian student visa, and they can undertake employment in India with no restriction.

Overseas Citizenship of India (OCI)

The Indian Overseas Citizenship of India (OCI) caters to Indian natives who hold a Person of Indian Origin and are living overseas. The OCI grants full citizenship to those who hold the PIO in their country of residence, with this visa they can exercise every right like a normal citizen living in India. However unlike the PIO Card, the OCI does not apply to the spouse of a qualifying applicant. The OCI is granted for life and offers the opportunity to apply for Indian citizenship after 5 years of residence. The OCI scheme is often incorrectly referred to as Indian 'Dual Citizenship'. The holder of an OIC enjoys many benefits, although not all the rights that and privileges enjoyed by enjoyed by those who hold an Indian citizenship, India does not support dual citizenship and an OCI should not be viewed as such. If applicants desire to have Dual citizenship their application must be supported by both countries concerned in order to be valid, and since India does not support the practice an OCI holder who's application for Indian naturalization gets granted they will be asked to renounce citizenship of any country other than India.
